INDIVIDUALISED FINANCIAL HELP FOR SENIOR CITIZENS- REGULATORY BASIS


The Senior Citizens Department of Torrevieja Town Hall has recently approved a set of individualised financial aids for senior citizens living in our municipality.
These financial aids aim to help senior residents cover their expenses made during years 2014, 2015 and 2016.
Please read more below in order to determine elegibility requirements as described in the Regulatory Basis.

Financial aids will start being granted during 2017. Submission terms and starting proceeding dates will be publicly and sufficiently announced in advance.

A. BASES (EXTRACT):

I. OBJECT
Facilitating social inclusion of senior residents of Torrevieja through locally regulated individualised financial aids.


II. AIM
Covering up for determined expenses made for age reasons by local senior residents, so they can better preserve their social life and their autonomy.


III. PERIOD OF TIME
This aid scheme is intended only for specified expenses made during the years 2014, 2015 and 2016 and are thoroughly described in the Regulatory Bases.


B. ELEGIBILITY:

1º. Petitioners must have reached the age of 65 at the time of form submission.

2º. Petitioners must not only fulfill all established requirements but present evidence of the requirement's fulfillment for each type of specific aid, as established in the Regulatory Bases.

3º. Petitioners must present and sign a Responsible Declaration together with the application form, in the sense of not being under one of the inelegibility causes as related in article 13 from the General Law on Subsidies 38/2003

4º Petitioners must not have benefited from other financial aids or subsidies granted for identical concepts, and they must declare that through a Responsible Declaration included in the application form.

5º Petitioners must be registered in the Torrevieja Municipal Census for the following periods:
- If requesting financial aid for expenses made during the year of 2014, petitioner must have been uninterruptedly registered in the municipality since the 1st of January 2013 and up to the moment of form submission.
- If requesting financial aid for expenses made during the year of 2015, petitioner must have been uninterruptedly registered in the municipality since the 1st of January 2014 and up to the moment of form submission.
- If requesting financial aid for expenses made during the year of 2016, petitioner must have been uninterruptedly registered in the municipality since the 1st of January 2015 and up to the moment of form submission.

6º Petitioners must have all tax payments due to the Treasury, the Social Security and the Town Hall, updated.


IV. PUBLIC FUNDS
The public funds destined to provide for this public service shall be charged to the Local Budget for the year 2015 and prorrogated for the year 2016, for a total amount of 475.716,40 euros.



V. BENEFICIARIES OBLIGATIONS

1. Properly justify before this authority the due fulfillment of the requirements and conditions established in these bases.

2. Allow the local authorities to carry out all control and verifying activities necessary.

3. Keep documental proof of payments of expenses made

4. In case of legal representation of the petitioner, proper legal representation documentation and a photocopy of ID card from the legal representative must be attached to the application form.





C. FINANCIAL AIDS TIPOLOGY


VI. HOME TELEASSISTANCE SERVICE

1.- What is it? It is an individualised financial aid destined to pay for the Home Teleassistance Expenses made by those senior pensionists that can not benefit from a free home teleassistance service due to their annual income rate.

2.- Special Requirements:

.- Applicant must live alone or with other people older than 65 years old.

.- Applicant's Annual Income must not exceed the amount of 18.637,85 euros.

.- Applicant must have a compatible land line at home and electricity supply.

.- Applicant must not suffer from a mental condition or senile dementia that may turn the service impossible to be adequately carried out.

.- Applicant must not suffer from hearing or speech impairments that may turn the service impossible to be adequately carried out.

.- Not having the teleassistance service already granted for free.


3.-Documentation

.- Fully completed form

.-ID photocopy

.-Health card photocopy

.- Collective Census Registration

.- Social Security's Certificate of pension

.- Medical Report for the purpose of social benefits granting.

.- Receipts of expenses allegedly made ( during years 2014, 2015 and 2016).

.- Proof of payment of such expenses


4.- Quantity:

A maximun and sole payment of 500 euros



VII. FINANCIAL AID FOR INSTITUCIONALISED CARE

1.-Concept:

A) It consists of a financial aid aimed to help paying officially accredited Nursing Homes for people older than 65 years old, daily care, health care, rehabilitation, comprehensive geriatric care; not compatible with other finantial aids granted for the same concepts by other administrative entities.

Situations of need to be covered:
- care after hospital discharge, when the main caregiver can not provide it

- temporary substitution of the main caregiver due to working, family or social reasons

- caregiver requires to have a break

- forced eviction from the habitual residency

- petitioner takes care of people unable to perform basic daily activities and in need of comprehensive geriatric care.

B) Also, it is a financial aid aimed to help paying stays in officially accredited Day Centres for people older than 65 years old and in order to help them stay in their habitual surroundings.


2.- Specific Requirements

.- Income per capita of each "coexisting unit" member can not exceed 1.5 times the cost of the Day Centre stay.

.- Situations of need must be within the ones listed above in number 1 paragraph.

.- No other financial aid has been already granted for the same reasons by any other public administration.

3.- Documentation

.-Fully completed form and annexes

.-Collective Census Registration

.- Proof of total income of the "coexisting unit".

.- Medical report for the purpose of social benefits granting issued by the primary care doctor.

.- Court Resolution declaring the legal incapacitation, together with evidence of legal representation and ID's photocopy of the legal representative.

.- Sworn Declaration of not being beneficiary of any other financial aid or subsidy for the same concept.

.- Receipts of expenses made during years 2014, 2015 and 2016

.- Proof of payment of such expenses.

4.- Quantity and Periods

A) Financial Aids for temporary Nursing Home Stay: the total cost, with a maximum payment of 2950 euros.

B) Financial Aids for Day Centre Stay: the total cost, with a maximum payment of 2800 euros.





VIII. FINANCIAL AID FOR THE SENIOR CITIZEN´S PERSONAL DEVELOPMENT

1.- Concept: finantial aids aimed to improve the autonomy and social relationships of senior citizens with mobility or sensory problems

2.- Tipology:

TECHNICAL AIDS FOR:

- Home adaptation and acquisition of necessary items for daily quality of life improvement.

- Personal adaptations (hearing aids, glasses....when not covered by the Social Security System)

- Repairs of hearing aid devices, prostheses....which can not be covered by any other insurance system.

3.- Specific requirements

.- Sensory or physical impairments resulting in mobility and social integration difficulties.

.- Financial aid must be destined to cover accessibility and comunication needs.

.- The "coexisting unit" total income does not exceed 11.182.71 euros per year.

4.-Quantity:

.- Home adaptation and items acquisition: maximum of 1500 euros.

.- Personal adaptations: maximum of 1500 euros

5. Documentation required:

.- Official application form duly completed by the petitioner or her/his legal representative.

.- Updated Census Certificate

.- ID card or Passport´s photocopy of the petitioner and all members of the "coexisting unity".

.- Proof of yearly income, as established above.

.- Proof of specific circumstances (medical reports, disability certificate, certificate of the degree of dependence recognised, etc...)

.- Receipts of expenses allegedly made ( years 2014, 2015 and 2016)

.- Proof of payment of such expenses




IX. FINANCIAL AIDS FOR PHARMACEUTICAL AND HEALTH EXPENSES

1.- Concept: they consist of financial aids destined to copay pharmaceutical and health expenses made for pensioners older than 65, when not covered by the Social Security System ( cosmetics and parapharmacy not included), during the years 2014, 2015 and 2016.
This finantial aid includes the petitioner's beneficiaries.

2.- Specific requirements:

.- Total yearly income of the "coexisting unit" must not exceed 18.637,85 euros

3.- Documentation:

.- Official application form duly completed, signed by the petitioner or his/her legal representative.

.- Updated Census Certificate

.- ID card or Passport´s photocopy of the petitioner and all members of the "coexisting unit".

.- Proof of yearly income, as established above.

.- Proof of specific circumstances (medical reports, disability certificate, certificate of the degree of dependence recognised, etc...)

.- Receipts of expenses allegedly made ( years 2014, 2015 and 2016)

.- Proof of payment of such expenses

4.-Quantity:

Maximum of 300 .




X. "EAT AT HOME" SERVICE.

1.- Concept: this finantial aid intends to cover for the "eat at home" service expenses, when the aid has been already granted but the persons is still on the waiting list.

2.-Specific requirements: technical report from the Social Welfare Department declaring the "eat at home" aid has been granted but the beneficiary is still on waiting list.

3.- Documentation:

.- Official application form duly completed, signed by the petitioner or his/her legal representative.
.- Updated Census Certificate
.- ID card or Passport´s photocopy of the petitioner and all members of the "coexisting unit".
.- Technical Certificate from the Social Welfare Department
.- Receipts of expenses allegedly made ( years 2014, 2015 and 2016)
.- Proof of payment of such expenses

4.-Quantity.
Real cost of expenses up to a maximum of 300 euros.



XI. DEFINITION OF "COEXISTING UNIT"
For the purposes of this bases, a "coexisting unit" will consist of 2 or more people living together in the same domicile, whether they are relatives or not.
Census must certify the "coexisting unit" through both the ordinary census certificate and the collective one.


XII. CONCEPT AND PROOF OF INCOME OF THE "COEXISTING UNIT"
1.- Income will consist of the sum of total gross incomes from all members of the "coexisting unit": salaries, bank interests incomes, movable assets, pensions and aids granted by public or private institutions, and the 1% of the cadastral value of real estate property other than the habitual residence including its parking spaces.

2.- Documentation that must be presented from all members of the "coexisting unit" aged 16 or more:

- Personal Income Tax from last fiscal year ( or Authorization Form attached in the ANNEX)
- Work contracts and last wages
- Certificate of Social Security Pensions and Benefits ( or equivalent social protection plan)
- National Employment Services Certificate
- Working Life Report issued by the Regional Social Security Treasury Office
- Unemployment Cards in case of lack of income
- Sworn Declaration of existing sources of income and financial means, if necessary (ANNEX)

3.- In case of discontinous financial incomes, only 2016 incomes and current ones will be computed.




D. PROCEDURE

XIII. TIME LIMITS AND PLACE FOR SUBMISSION

1.- 15 working days starting to count from the date of Regulatory Bases Extract Publication in the BOP ( Provincial Official Bulletin)

2.- Place: Town Hall General Registry (PROP)


XIV. EXTRA TIME IN CASE OF MISSING DOCUMENTATION
10 additional days will be granted to the petitioner in order for him/her to complete all legally required documentation if there were some mandatory documents missing at the moment of submission.


XV. FILE PROCESSING
Senior Citizen's Department will be competent for submissions processing.
A technical report wil be opened for each case submitted.
Once the file is completed with all documentation required, an Assessment Committee will decide on each case.


XVI. ASSESSMENT COMMITTEE
The Committee will decide on each case submitted, and the Committee will be composed, at least, of one Delegate Councillor from the Senior Citizen's Department and of 3 municipal and competent technicians.


XVII. ASSESSMENT CRITERIA

Submitted forms will be asessed according to the level of total income of the "coexisting unit", and according to the type of aid requested. Please check detailed assessment parametres in the Spanish text.


XVIII. FINAL AMOUNT
Final amount will be established according to the results of the application of assessment criteria, with a maximun of 2.950 euros per petitioner and within the maximum amounts established by the Regulatory Bases for each financial aid type.


XIX. FILE RESOLUTION
Final resolutions will be communicated to the submissioners in accordance with article 58 of the Law on Common Administrative Procedure.
They will be published in the Town Hall webpage, the Town Hall Notice Boards, the Senior Citizens Department and the Centres for the Elderly dependant on the Town Hall.
Petitioners will be granted 10 days for further allegations.
Final resolutions will contain the definitive list of beneficiaries, benefit's type and amount granted.
Definitive resolutions will be published in the National Subsidies Database, the Provincial Official Bulletin, the Town Hall Notice Boards and the Senior Citizens Department.
Final resolutions will be taken in any case within the next 3 months, starting to count on the day inmediately after the last legally established day for application form submissions.
The lack of written resolution on any particular case will be formally considered as a denial (in virtue of the "negative administrative silence"), and all final resolutions, whether written or not, can be appealed through the administrative procedures regulated in the Law 30/92 on Common Administrative Procedure.


XX. FORM OF PAYMENT
Payments will be made through bank transfer and after presentation by the beneficiary of proof of payment of the expenses covered by this financial aid


XXI. PROOF OF EXPENSES
Expenses made by the beneficiary, for the purposes of this finantial aid, as listed above, will have to be proved with due receipts and invoices.
- proof of bank transfer, with invoice number or concept of transfer
- copy of the nominative check or bank statement of the direct debit, together with the concept for the payment.
- cash payments (maximum of 2500 euros): invoice and signed receipt of cash received by the provider, with expression of his/her identity and business name.


XXII. FINANCIAL CONTROL
Financial control will be carried out in the terms of the General Law on Subsidies and its Regulation, as approved by the Royal Decree 887/2006 of the 21st of July.


XXIII. COMPATIBILITY
These financial aids are not compatible with other aids or subsidies granted to the petitioner for the same purposes or reasons.


XXIV. PUBLICATION
These bases will be published in the National Subsidies Database, the Official Provincial Bulletin, the Town Hall Notice Boards and the municipal website.
Subsidies granted will be published in the National Subsidies Database and the Official Provincial Bulletin with expression of the beneficiary's name, the amount granted and the subsidy's aim.


ADDITIONAL PROVISION
The TORREVIEJA TOWN HALL GENERAL ORDINANCE on SUBSIDIES will be applicable for any complementary legal aspect not especifically regulated in these bases.
