PRIOR PUBLIC CONSULTATION IN THE PROCEDURE FOR THE PREPARATION OF THE DRAFT REGULATIONS GOVERNING THE SECTORAL COUNCIL FOR CITIZEN PARTICIPATION OF THE TORREVIEJA CITY COUNCIL.
Whereas Article 133.1 of Law 39/2015 of October 1, on the Common Administrative Procedure of Public Administrations, establishes that, prior to the drafting of a bill or draft bill or regulation, a prior public consultation will be conducted through the website of the competent Administration, in order to gather the opinions of the most representative individuals and organizations potentially affected by the future regulation. Its purpose is to collect the opinions expressed by citizens and those directly affected by the proposed legislation. In other words, at this initial stage, the public consultation does not aim to produce a text already structured as a regulation, but rather, the contributions from citizens seek to identify regulatory needs or public perceptions regarding a specific matter that is to be regulated.
Considering that in the present case there are sufficient reasons to deem it appropriate to conduct a prior public consultation. Specifically : a) The proposal consists of the approval of a regulatory text of general scope and intended to be permanent, aimed at regulating the creation of the body, its composition, its functions, its basic operating rules, etc.; b) The future regulation will directly affect associations registered in the municipal register, potentially represented citizen entities, and residents interested in municipal participation mechanisms; and c) Conducting the prior public consultation is fully consistent with the principles of transparency, participation, legal certainty, efficiency, and good administration.
The Councillor Delegate for Citizen Participation has ordered a 20-day public consultation period for the upcoming drafting of a Regulation for the Sectoral Council for Citizen Participation of the Torrevieja City Council , in accordance with the provisions of Article 133.1 of Law 39/2015, in order to ascertain the opinion of the subjects and the most representative organizations potentially affected by the future regulation regarding:
a) The problems that the initiative aims to solve. |

b) The need for and opportunity of its approval. |
c) The objectives of the standard. |
d) Possible alternative regulatory and non-regulatory solutions. |
