PRELIMINARY CONSULTATION ON THE DRAFT ORDINANCE REGULATING THE PUBLIC NON-TAX ASSET CONTRIBUTION FOR THE SERVICE OF REGULATING THE TEMPORARY OCCUPATION OF PUBLIC ROADS FOR PARKING VEHICLES UNDER TIME CONTROL
In accordance with the provisions of Article 133 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, with the aim of improving citizen participation in the rulemaking process, prior to the drafting of the aforementioned ordinance, a public consultation will be carried out, in which the opinions of citizens and the most representative organizations potentially affected by the future regulation will be gathered in relation to:
a) The problems that the initiative aims to solve.
- Problems of saturation and low turnover: in several areas adjacent to the city center, a shortage of parking for residents and workers has been detected, with insufficient turnover to support commercial and economic activity. The aim is to prevent prolonged parking in congested central areas, better distribute public space, and prioritize residents with parking difficulties.
- Problems stemming from a lack of regulatory instruments to improve regulation. Tariffs and discounts for new uses need to be adjusted. Users should be segmented according to their needs: residents, workers, turnover, logistics, etc. Zones and schedules need to be adapted to the needs of busy central neighborhoods.
- Problems of regulatory coordination with other regulations. The new regulations must be aligned with the adaptation of the Low Emission Zone (LEZ) and the need to integrate regulated parking as an instrument for access management and emissions reduction.
b) The need for and timeliness of its approval. The reasons are as follows:
- The need to provide the City Council with adequate regulatory instruments to establish a clear framework that allows for the ordering, supervision and control of vehicle parking in regulated areas, to guarantee parking for residents in high-traffic central areas and to allow for the proper use of public space to promote the city's economic and commercial activity.
c) The objectives of the standard.
- Approve regulations that adapt to the new service management framework. Regulate the new schedules, new zones, and resident status.
- Introduce control and sanction procedures that are in line with new technological means. Implement measures that are in line with new regulatory possibilities.
- Optimize road resources, improve vehicle turnover, reduce traffic congestion, and facilitate access to commercial and high-density urban areas
- Guarantee the responsible, sustainable and social use of parking.
- Integrate the regulations into local policies and strategies. Include references to current regulations related to vehicle access control and the reduction of polluting emissions.
d) Possible alternative regulatory and non-regulatory solutions.
- No alternative is apparent. Approval of the ordinance is considered the most appropriate option to guarantee the objectives described.
In order to facilitate public consultation prior to the drafting of said Ordinance, it is published on the municipal website of the Torrevieja City Council in the section “Draft Regulations and Ordinances. Prior Public Consultations” at www.torrevieja.es , as well as on the Municipal Notice Board.
Suggestions and contributions to this prior public consultation may be submitted through the following channels within 20 working days from the day following publication on the municipal website and on the Municipal Notice Board:
- By means of a written document addressed to the General Registry of the Torrevieja City Council in person or through an electronic office.
