REGULATORY BASIS AND CALL FOR AID FOR THE BIRTH AND/OR ADOPTION OF CHILDREN IN THE CITY OF TORREVIEJA. CALL FOR 2025.
1 OBJECT
These rules are intended to regulate the application, processing, and granting of grants awarded by the Torrevieja City Council for the birth and/or adoption of children.
These grants are legally based on Articles 39, 137, and 140 of the Spanish Constitution, and Articles 1 and 2 of Law 7/1985, of April 2, on the Foundations of Local Government.
This call for aid will cover births occurring during 2024, from January 1, 2024, to December 31, 2024.
2. BENEFICIARIES AND APPLICATION PERIOD.
Married couples, common-law couples, and single-parent families with family records or birth certificates for births that occurred in 2024, i.e., from January 1, 2024, to December 31, 2024, are eligible to apply for the subsidy.
In cases of annulment, separation, or divorce, the beneficiary of the benefit will be the parent in whose custody the children are to remain, in accordance with the provisions of the regulatory agreement or court ruling of annulment, separation, or divorce. In the case of shared custody, the benefit will be distributed 50% between the parents.
In any case, with respect to the same cause, meaning the minor born during the period stipulated in this call, only one of the two parents or adoptive parents may be a beneficiary of the aid, acting on their own behalf or representing the cohabitation unit.
Interested persons who are minors must act through a legal representative, unless they are emancipated.
Parents who have been totally or partially deprived of parental authority over their children or whose guardianship has been assumed by a public institution may not be beneficiaries.
Foreigners who meet the requirements of these rules (including registration requirements) may be beneficiaries provided they meet the conditions of legal residence in Spain (Organic Law 4/2000, of January 11, on the rights and freedoms of foreigners in Spain and their social integration, and implementing regulations).
Those adopting a minor with an adoption resolution from January 1, 2024, to December 31, 2024, may apply for assistance.
The application period for aid will be 30 business days from the day following the date of publication of this Call.
This aid is "requested" and will be granted in strict order of request, based on compliance with the requirements established in these regulations and within the limits of the appropriations allocated in the Municipal Budget.
3 REQUIREMENTS FOR BENEFICIARIES
The requirements to qualify for the grant are:
1. Be a Spanish citizen or a foreigner legally residing in Spain. (If foreign, be a holder of a NIE)
2. Be over 18 years of age or a legally emancipated minor.
3. Beneficiaries must be registered in the city of Torrevieja and have been registered for at least three consecutive years. The newborn must be registered for the first time in the city of Torrevieja, at the address of the beneficiary of the aid.
4. Be the holder of a bank account.
5. Not be in any of the cases of prohibition of beneficiary of subsidies contemplated in art. 13 of Law 38/2003, of November 17, general subsidies, except letters e) and g) of section 2 of said precept, in attention to what is stated in the first paragraph in fine of the aforementioned art. 13.2, when it says "unless by the nature of the subsidy it is excepted by its regulatory regulations", since, otherwise, the purpose pursued by these aid would decline by preventing people with temporary or permanent economic difficulties from accessing them, which would have a negative impact, without any justification, on the minor, whose well-being, attention and care are intended to safeguard and guarantee through the granting of these aids and would be harmed by a situation that affects his/her parent or adoptive parent, for which reason there are reasons of public and social interest to except the aforementioned prohibitions.
4 GRANT PROCEDURE
These grants will be awarded directly, motivated by reasons of social interest, until the budget allocation is exhausted. Several resolutions will be issued throughout the year, without waiting for the call period to expire.
Since it is not necessary to compare applications or prioritize them, applications submitted on time will be processed individually, in consecutive order according to the registration record at this City Hall.
5 APPLICATION
Applications for assistance should preferably be made through the Torrevieja City Council's Electronic Office at torrevieja.sedelectrónica.es, using the specific procedure enabled for this purpose, "Application for assistance for birth," by completing the application form provided for this purpose and attaching the required documentation. Applications can be made through a representative.
Applications may also be submitted in person at any SAIC (Citizen Information and Assistance Service) office in the municipality of Torrevieja, or by any of the methods specified in Article 16 of Law 39/2015 on the Common Administrative Procedure of Public Administrations.
Applications MUST be accompanied by the following documentation:
• Photocopy of the beneficiaries' valid ID/residence card.
• Birth certificate issued by the Civil Registry/adoption resolution.
• Certificate of ownership of the applicant's bank account where the deposit must be made.
• In the absence of express authorization, the beneficiaries' registration certificate, including the newborn, must be provided.
• Regulatory agreement or court ruling of annulment, separation or divorce, as applicable.
6. AMOUNT
The benefit amount will be 450 euros per child born and/or adopted.
In the case of multiple births, a benefit of 450 euros may be requested and received for each child born.
